Robert F. 'Bob' Middleton

Bob has extensive and diverse experience representing clients in complex business, construction and commercial litigation matters, specifically including complex bank and real estate litigation, breach of contract litigation, product liability, construction litigation, litigation, and multinational disputes. Bob has litigated various high-stakes disputes at trial and appellate levels in both state and federal court.

Representative examples include: (1) breach of contract litigation involving a $6 billion asset sale of Tenneco oil and gas business to Fina; (2) indemnification claims concerning multimillion dollar contract disputes; (3) oil and gas contract interpretation disputes as General Counsel for the Southwest Conference, (a former college athletic conference), for many years he handled many interesting disputes as we as (4) litigated a case involving the Dallas Morning News and SMU to a win in the Fifth Circuit Court of Appeals; (5) litigated on behalf of a number of Fortune 100 corporations involving various disputes; (6) handled class actions, in both federal and state courts in product liability matters in defense of manufacturers (including asbestos) and breast implants; (7) represented real estate developer Trammell Crow personally and in real estate and partnership disputes; (8) international arbitration involving multi-million dollar claims and cross-claims between a German corporation and a Latin American country that grew out of a pipeline maintenance contract; and (9) a multitude of banking and finance issues, including litigation surrounding financing.

Bob has also worked on troubled assets assignments with the FDIC, FISLC, OTC, and the Resolution Trust and later for the so called “bad bank” which was previously Bank One and also in debt restructuring for borrowers. Early in his career he was Associate General Counsel of Farm and Home Savings, at the time, then the ninth largest Savings and Loan.

Bob also has considerable experience in alternative dispute resolution. He has been an American Arbitration Association, Large and Complex Panel Arbitrator since 1998. He has handled major contract arbitrations for Tenneco, GTE, American Airlines, and disputes between Fortune 100 telecommunications corporations.
